What is the current state of legality regarding medical cannabis in Mississippi?

As of 2022, medical marijuana is legal in Mississippi. However, recreational marijuana remains illegal. If you are over 18, you can get your medical card and purchase cannabis products from licensed dispensaries throughout the state.

Given this fact, it is still illegal for any patient to smoke in public in Mississippi, and it is also illegal to grow marijuana in the state.

Can I own or purchase a gun if I have a medical cannabis card?

Yes, you can own a gun with a medical card in Mississippi. Section 8(3) of the Mississippi Medical Cannabis Act says that registered medical cannabis patients in the state won’t be denied the right to own or purchase guns. However, patients will still be subject to a background check when purchasing a firearm.

2016’s Mississippi Church Protection Act (House Bill 786) states marijuana patients 18 or older don’t need a gun license to carry firearms in purses, handbags, holsters, or sheaths.

If you already have a firearm license, you can get a medical cannabis card. Also, your spouse is not prohibited from owning firearms in this case.

If I am pulled over, does my medical card allow me to have cannabis on my person?

According to Code Ann. § 41-137-29, if you are stopped, there will be a verification process to ensure you are a registered medical cannabis patient in the State. However, make sure you don’t have more than the legally allowed limit of medical cannabis, which is 98 grams, or 3.5 ounces at any given time.

There are a few other rules to consider. Don’t transport medical marijuana across state lines. And remember that other states may not recognize an out-of-state card. In that case, it isn’t legal to possess marijuana in other states. Also, smoking or vaporizing cannabis in a motor vehicle, or anywhere in public, remains illegal.
